An Act to Ensure Menstruation Products for Students

1 BE IT ENACTED BY THE TENNESSEE YMCA YOUTH IN GOVERNMENT

3 Section 1: Terms in this act will be defined as follows:
4 a. Menstruation Products: Any product that is used to catch a menstrual flow, this includes
5 products such as pads and tampons.
6 b. Periods: The periodic discharge of tissue and blood from the uterus.
7 c. 6- 12 grades: Refers to students in the sixth grade through the twelfth grade, generally middle
8 and high schools.
9 D. Public School: A learning institution that is funded by local, state, or federal governments.

11 Section 2: All public middle and high schools, or schools with students grades 6-12, within the
12 state of Tennessee, will be required to offer menstruation products in every bathroom on their
13 campus.

15 Section 3: Each school district will have the authority to determine the brand menstruation
16 products offered in their schools, given:
17 The products chosen have received approval by the U.S. Food and Drug Administration (FDA).
18 The products provided must be offered in a variety in order to encompass the needs of every
19 student.

21 Section 4: School districts will have the authority to determine the amount of products offered to
22 their students based on the number of students and bathrooms within the school.

24 Section 5: At least twice each year, the Tennessee Department of Education shall survey
25 bathrooms within school campuses of every district in order to determine if the needs of students
26 are being met.

28 Section 6: Students will have the right to report the lack of menstruation products in their
29 restrooms. This will be done by contacting the local school board or the Tennessee Department of
30 Education.

32 Section 7: If enacted, no public middle or high school in the state of Tennessee may be exempt
33 from this requirement.

35 Section 8: If enacted, schools and districts that do not abide will face a fine of $20,000 paid to the
36 state of Tennessee.

39 Section 10: If enacted, 50 percent of the state sales tax collected on feminine hygiene products
40 will be deposited in a separate account from which the state will fund 9,400,000 dollars each year
41 to be distributed among individual school districts.

43 Section 11: All laws of parts of laws in conflict with this are hereby repealed.

45 Section 12: This act shall take effect in August of the 2024- 2025 school year, the public welfare
46 requiring it.
