1 BE IT ENACTED BY THE TENNESSEE YMCA YOUTH LEGISLATURE:

3 Section 1: Terms in this act are defined as follows:
4 Minor- someone under an age of reason, which sets the boundary of an underage individual from
5 legal adulthood
6 Vlogger/Blogger- an individual or family that creates video content, performed in Tennessee, in
7 exchange for compensation, and includes any partnership, company, or other corporate entity
8 assuming the name or identity of a particular individual or family for the purposes of that content
9 creation.
10 Monetization- refers to the potential to generate revenue via a blog, other forms of content, or any
11 other mode of online presence. Affiliate programs, e-commerce, hosting premium content,
12 advertising, and other revenue-generating activities are all examples of monetization.
13 Vlog/Blog- content shared on an online platform in exchange for compensation.
14 Online platform- any public-facing website, web application, or digital application, including a
15 mobile application. "Online platform" includes a social network, advertising network, mobile
16 operating system, search engine, email service, or Internet access service.
17 Compensation- any form of payment made to an individual for services rendered as an employee
18 for an employer; services performed as an employee representative
19 Trust fund- legal arrangements that allow individuals to place assets in a special account to benefit
20 another person or entity.
21 Age of majority- the age at which an individual will be legally considered an adult.

23 Section 2: An individual who is a minor featured in the work of vlogging/blogging on any
24 monetized vlog/blog on any online platform must be compensated 30% of the revenue made
25 within the first 30-days into a trust fund. This includes their likeness, name, or photograph. This
26 trust fund can be accessed when they have reached the age of majority (18 in the state of
27 Tennessee) and can ask for the content to be taken down.

29 Section 3: This excluded any self-made minor influencers who produce all their own content
30 including the digital process and financial aspect.

32 Section 4: Under this act, the parents or guardians can and will be sentenced to jail for a minimum
33 of 30 days or fined a minimum of $50 per vlog uploaded featuring the minor.

35 Section 5: This act will not require funding from the state budget but may generate revenue
36 resulting from income taxes and fines.

38 Section 6: All laws and parts of laws in conflict with this act are hereby repealed.
39 Section 7: This act shall take effect January 1, 2025 upon becoming a law.
