1 BE IT ENACTED BY THE TENNESSEE YMCA YOUTH IN GOVERNMENT

3 Section 1) Terms in this act shall be defined as follows:
4 Landlord: A person who rents out residential property to tenants.
5 Absentee Landlord: A person whose primary residence is not within a 100-mile straight line
6 distance of any secondary properties.
7 Nuisance: As defined in TCA 29-3-101
8 Local: Within a 100-mile straight line of the property

10 Section 2) A landlord must have their primary residence within a 100-mile straight line distance of
11 any secondary properties. They must provide a name and the appropriate contact information for
12 the property manager, which may include their own.
13 If the landlord resides outside of the 100-mile straight line distance they must provide the
14 following information.
15 The name and appropriate contact for a local maintenance person or company.
16 A publicly available business contact for all rental properties.

18 Section 3) If a nuisance occurs on a property owned by an absentee landlord and it is not resolved
19 by a local maintenance person or company within 2 weeks, the landlord can be subjected to a
20 penalty of 10% of the monthly rental income per week for a first offense, 20% for a second
21 offense, and 35% for any reoccurring offenses.
22 All fines collected from this bill will be delegated to the Tennessee Department of Health as they
23 have jurisdiction over Property Maintenance Codes.

25 Section 4) There is no cost to the state, but will generate profit from fines.

27 Section 5) All laws or parts of laws in conflict with this act are hereby repealed.

29 Section 6) This act shall take place on January 1st, 2026, the public welfare requiring it.
