1 | BE IT ENACTED BY THE TENNESSEE YMCA YOUTH IN GOVERNMENT |

3 | Section 1) Terms in this act shall be defined as follows: |
4 | a. School day: any day pupils grades 1 through 12 are present at school or school facility for |
5 | purposes of instruction or educational activities, including, but not limited to state-funded |
6 | preschool, transitional kindergarten, summer school, extended school year days, and school field |
7 | trips. |
8 | b. Public School: Any educational institution which is funded and run by the state. |

10 | Section 2) |
11 | (A) During the working hours of the public school, food containing the following substances may |
12 | not be sold to students: |
13 | a. Blue 1 (CAS 3844-45-9). |
14 | b. Blue 2 (CAS 860-22-0). |
15 | c. Green 3 (CAS 2353-45-9). |
16 | d. Red 40 (CAS 25956-17-6). |
17 | e. Titanium dioxide (CAS 13463-67-7). |
18 | f. Yellow 5 (CAS 1934-21-0). |
19 | g. Yellow 6 (CAS 2783-94-0). |

21 | (B) Any Public school may permit the sale of food items that do not comply with Subdivision (A) as |
22 | part of a fundraising event in either of the following circumstances: |
23 | a. The sale of those items takes place off school property. |
24 | b. The sale of those items takes place on school property at least a half hour after the end of the |
25 | regularly scheduled school day. |

27 | Section 3) All adjustments made to school meals shall be made in accordance with the National |
28 | School Lunch Program |
29 | |
30 | Section 4) Must be enforced by Tennessee Department of Education School Nutrition Program |

32 | Section 5) This act shall be funded by Tennessee Department of Education |
33 | |
34 | Section 6) All laws or parts of laws in conflict with this act are hereby repealed. |

36 | Section 8) This act shall take effect on August 1, 2024 |
