AN ACT TO REGULATE APPROVED INGREDIENTS IN SCHOOL NUTRITION PROGRAMS

1 BE IT ENACTED BY THE TENNESSEE YMCA YOUTH IN GOVERNMENT

3 Section 1) Terms in this act shall be defined as follows:
4 a. School day: any day pupils grades 1 through 12 are present at school or school facility for
5 purposes of instruction or educational activities, including, but not limited to state-funded
6 preschool, transitional kindergarten, summer school, extended school year days, and school field
7 trips.
8 b. Public School: Any educational institution which is funded and run by the state.

10 Section 2)
11 (A) During the working hours of the public school, food containing the following substances may
12 not be sold to students:
13 a. Blue 1 (CAS 3844-45-9).
14 b. Blue 2 (CAS 860-22-0).
15 c. Green 3 (CAS 2353-45-9).
16 d. Red 40 (CAS 25956-17-6).
17 e. Titanium dioxide (CAS 13463-67-7).
18 f. Yellow 5 (CAS 1934-21-0).
19 g. Yellow 6 (CAS 2783-94-0).

21 (B) Any Public school may permit the sale of food items that do not comply with Subdivision (A) as
22 part of a fundraising event in either of the following circumstances:
23 a. The sale of those items takes place off school property.
24 b. The sale of those items takes place on school property at least a half hour after the end of the
25 regularly scheduled school day.

27 Section 3) All adjustments made to school meals shall be made in accordance with the National
28 School Lunch Program

30 Section 4) Must be enforced by Tennessee Department of Education School Nutrition Program

32 Section 5) This act shall be funded by Tennessee Department of Education

34 Section 6) All laws or parts of laws in conflict with this act are hereby repealed.

36 Section 8) This act shall take effect on August 1, 2024
