AN ACT TO PROTECT REAL ESTATE AGENTS FROM UNWARRANTED HARASSERS AND VIOLENT CLIENTS

1 BE IT ENACTED BY THE TENNESSEE YMCA YOUTH IN GOVERNMENT
2 Section 1) Terms in this act shall be defined as follows:
3 a. Employee: one employed by another usually for wages or salary and in a position below the
4 executive level.
5 b. Professional Priveldge Tax: Professional privilege tax is due June 1 each year of individuals
6 licensed or registered to practice in Tennessee in any one of the professions listed: attorney,
7 agents (security), broker dealer, investment advisor, and lobbyist. If you are registered or licensed
8 to practice in more than one of the following professions, you are only required to pay the $400
9 tax once per year.
10 c. Real estate industry: The real estate industry encompasses the many facets of property,
11 including development, appraisal, marketing, selling, leasing, and management of commercial,
12 industrial, residential, and agricultural properties.
13 d. Real estate agent: a person who sells and rents buildings and land for clients.
14 e. Self-contractor: A self-employed person or entity contracted to perform work for- or provide
15 services to- another entity as a non-employee.
16 f. Sexual harassment: uninvited and unwelcome verbal or physical behavior of a sexual nature
17 especially by a person in authority toward a subordinate
18 g. Weapon: an item designed or used for inflicting bodily harm or physical damage.
19 h. Tennessee Association of Realtors: association that allows a central point for realtors to
20 communicate and be contacted.
21 i. Title VII: prohibits employment discrimination based on race, color, religion, sex and national
22 origin. It prohibits harassment based on the victim’s membership in a protected class.

24 Section 2) The required classes to renew a realtor license will now include self-defense classes.
25 a) Basic self-defense, how to use common items as weapons, how to properly deal with and calm
26 down any hostile clients or people, will be required by the state of Tennessee in order to renew the
27 real estate license.

29 Section 3) The law will also protect against harassment in the workplace. Workplace will be defined
30 as someone who works in a licensed buisness, including self-emloyed workers.

32 Section 4) This act shall be funded by the Professional Privilege Tax. Each self-defense class costs
33 about $50-$75 per person and there are over 35,000 licensed realtors in Tennessee.

35 Section 5) All laws or parts of laws in conflict with this act shall be hereby repealed.

37 Section 6) This act shall take effect on January 1st, 2025.
